You agree to indemnify, defend, and hold harmless DOND Naturals LLC, its members (including Dr. Scott Kwiatkowski and Dr. Mark Dunn individually), managers, officers, affiliates, subsidiaries, related entities, DBAs, agents, contractors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, and expenses — including reasonable attorneys’ fees — arising out of or relating to:

     •  Your purchase or use of any DOND Naturals product

     •  Your breach of these Terms

     •  Your violation of any applicable law or the rights of any third party

Return of Proceeds — You also agree that if you bring or participate in any claim, suit, or action against DOND Naturals LLC or its members — and any monetary award or settlement is made to you or any party on your behalf — you will immediately return in full to DOND Naturals LLC all compensation, proceeds, or awards received as part of or arising from that action. This obligation survives the termination of these Terms and any resolution of the underlying dispute.

Section 6 — Dispute Resolution & Binding Arbitration

By using this site or purchasing any product, you waive your right to sue DOND Naturals LLC in court or participate in any class action.

Any dispute, controversy, or claim arising out of or relating in any way to these Terms, the Site, or any DOND Naturals product — whether in contract, tort, statute, or otherwise — shall be resolved exclusively and finally by binding individual arbitration. This includes claims that are pre-existing, present, or future.

Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The Federal Arbitration Act governs the interpretation and enforcement of this Section.

The arbitrator shall have exclusive authority to resolve any disputes relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement. The arbitrator may award any relief that would be available in a court of law. Any award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You agree to arbitrate on an individual basis only. Neither you nor DOND Naturals LLC may consolidate claims with those of any other person, participate in a class action, or act as a private attorney general in any arbitration or court proceeding.

Any cause of action or claim you may have arising out of or relating to these Terms or the Site must be commenced within one (1) year after the cause of action accrues. After that period, such claim is permanently barred.

Section 7 — Orders, Pricing & Product Availability

All orders are subject to acceptance by DOND Naturals LLC. We reserve the right to refuse or cancel any order at any time for any reason, including suspected fraud, resale intent, or violation of these Terms.

Prices are subject to change without notice. We are not responsible for typographical errors in pricing. If a pricing error is discovered after your order is placed, we will notify you and you may choose to proceed at the correct price or cancel your order.

Product availability is not guaranteed. If a product becomes unavailable after your order is placed, we will notify you and issue a full refund.

DOND Naturals products are sold for personal, non-commercial use only. You may not resell or redistribute any product without our express written consent.
